Effective December 23, 2010, petitioners of nonimmigrant workers will be required to utilize revised USCIS Form I-129. In an effort to ensure compliance with U.S. Export Control regulations, new I-129 Petition for a Nonimmigrant Worker requires Certification Regarding the Release of Controlled Technology or Technical data to Foreign Persons in the United States after the petitioner has reviewed deemed export license requirements.

Technology or source code is considered to be exported not only under the traditional sense of shipping it overseas, but it can also be “deemed” to take place when it is released to a foreign national within the United States. The Export Administration regulations (EAR) (15 CFR Parts 770-774) and the International Traffic in Arms Regulations (ITAR) (22 CFR Parts 120-130) requires obtaining an export license issued by the U.S. Government before deemed exports may be authorized. The controlled technology and technical data that are controlled for release to foreign persons are identified in the EAR’s Commerce Control List (CCL) and the ITAR’s U.S. Munitions List (USML). While most types of technology are not controlled for export or release to foreign persons and therefore licensing would not be required, petitioners of nonimmigrant workers employed as H-1B, L-1, or O-1A beneficiaries, will be now required to explicitly make the attestation of compliance with export control laws.

As sponsoring employer, UTHealth is required to certify that it has reviewed the EAR and the ITAR and determined that either: 

(1) A license is not required from either the U.S. Department of Commerce or U.S. Department of State to release such technology or data to the Beneficiary, or

(2) A license is required from either the U.S. Department of Commerce and/or U.S. Department of State to release such technology or data to the Beneficiary, and that UTHealth will prevent Beneficiary’s access to the technology and/or data until a license or other authorization is obtained.

** Prevailing Wage Determination Changes and H-1B Employment Visa New Instructional Packet, Effective Jan. 1, 2010

Please be informed that as of Jan.1, 2010, the U.S. Department of Labor, in accordance with its labor certification regulations is receiving and processing Prevailing Wage Determination (PWD) requests for use in the

    H-1B,

    H-1B1 (Chile and Singapore),

    H-1C, H-2B, E (Australia), and

    permanent labor certification programs

through its Office of Foreign labor Certification (OFLC) National Prevailing Wage and Helpdesk Center (NPWHC) in Washington D.C.

ETA Form 9141 must be used to request a PWD following specific filing procedures as published in the Federal Register / Vol. 74, No 232 and following the requirements set forth in 20 CFR 655.10, 655.11, 655.731, 655.1112, 656.40 and 656.41, as applicable .Federal Register NPWDnotice

    After Jan. 1, 2010, obtaining PWD from the NPWHC is a process expected to take several weeks longer than before, as all requestors must use form ETA 9141 and submit PWD requests to the NPWHC.

    Since Jan. 21, 2010 employers are able to submit ETA Form 9141 electronically through iCERT (DOL electronic system) to obtain a National Prevailing Wage and Helpdesk Center (NPWHC) prevailing wage determination (PWD). While electronic submission is expected to speed up the process, it is unlikely that the overall time to obtain a PWD improves significantly.

Therefore, when entertaining the possibility of hiring an employee requiring H-1B visa sponsorship, it is critical that both hiring authorities and current or prospective employees acquiring or extending this visa status carefully consider the length of time at hand and refer to the Office of International Affairs (OIA) Visa Timelines Chart or consult with an International Advisor to be sure a visa request is submitted for processing with ample time according to a desired start date of employment.
