After Hour Warrant Applications by UTCHPC Staff

A request for issuance of a Mental Health Warrant (EDO) after 4:00 p.m. weekdays and on weekends and holidays will be pursued when appropriate as indicated by a clinical screening assessment. Determinations of an emergent "harm to self or others" condition existing, and an assessment of agreement for services between provider and potential patient will be made. The person's safety and well-being is a priority concern.

Who may apply for the warrant?

UT Police Officers may complete A22 Application for Emergency Detention (completed/notarized A22 is sufficient to hold patient while paperwork defined = described in Steps I 1-6 is in process) ; see policy, “Security/UT Police vs. Clinical Roles in Common Areas.”

Application process

Follow these steps to apply for an after hours warrant:

Completes entire form A20 Application-Emergency Detention-Section 28(a)

Ensures that there is sufficient specific information regarding the patient's behavior to indicate danger to self or others.

Upon completion, has the form notarized

Calls Justice of the Peace (JP) clerk at (713) 755-7092 to notify the clerk that warrant paperwork is being faxed ; fax Police Officer’s A22 if there is one, with indication that “additional information will follow shortly. ”

Completes top of form A18 Warrant-Emergency Apprehension and Detention-Section 28(e) down to date line and stop

Completes A19 Magistrate's Order for Emergency Apprehension and Detention-Section 28(e) except for the signature line

Completes form F11 Preliminary Medical-Section 27(a) (Certificate of Preliminary Medical Examination)

Ensures that there is sufficient specific information regarding the patient's behavior to indicate danger to self or others.

Upon completion, has the form notarized

Staff

Notarizes A20, F11, A22

Calls Justice of the Peace (JP) clerk at (713) 755-7092 to notify the clerk that additional paperwork is being faxed

Faxes the following to the JP clerk at (713) 755-6004:

A completed fax cover sheet noting the applicant's contact phone and fax numbers

Completed forms (A18, A19, A20, F11)

UTHCPC Social Service Clinician

Goes to Probate Court at UTHCPC on the first succeeding business day and complete the paperwork for an Order of Protective Custody (OPC)

Notifies the treating physician that the first medical needs completing
